In the following terms & conditions, “the creator” shall mean Joe Early trading as “Library Of Sounds”. “The client(s)” shall be those persons commissioning the creator, including any affiliates. It is mutually agreed that the following terms of agreement form an integral part of booking the creator and cannot be varied by the client(s) unless such conditions are expressly agreed by the creator in writing. By booking with the creator you agree to the below Terms and Conditions.

Please note: By booking a Library Of Sounds service, you automatically agree to these terms and conditions. If you wish to discuss the agreement, please contact Joe Early.

1. Bookings
1.1 A payment agreement will be discussed at the time of booking in the confirmation of a quote document in order to reserve and secure the date & time of the service unless otherwise confirmed by Joe Early - Library Of Sounds. In writing. This is part of the booking process and will be logged for future notice.

1.2 All deliverables are subject to a 1-2 week post-processing time unless otherwise agreed by Joe Early - Library Of Sounds.

2. Payments
2.1 Balances owed for Library Of Sounds services must be paid in full upon receipt of the invoice. An invoice will be issued alongside deliverables upon which any outstanding monies will be owed immediately.

2.2 Payment for all extra items ordered must be made at the time of ordering. Prices for prints, copyright releases and digital copies are available upon request.

2.3 If payment is not received within 30 days of the invoice due date, a 10% increase will be added to the initial invoice. This will continue to increase for every 30 days past the stated due date.

3. Prices
3.1 All charges and additional services specified during the contact period between client(s) and Joe Early - Library Of Sounds will be priced up and quoted for and agreed upon before confirming the booking.

4. Display & Publishing
4.1 The client(s) hereby allow(s) Library Of Sounds and associates to display any photograph/video/graphics covered by this contract and to generally promote the business in all forms of media platforms including digital, print and social media.

5. Licence, Coverage & Reproduction
5.1 Photographs/videos taken during the session/event will be at the discretion of the creator although every effort will be made to comply with the client's requirements.

5.2 The creator shall be granted artistic license in relation to the poses photographed/videoed and the locations used. The creator’s judgement regarding these matters shall be deemed correct.

5.3 Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the creator will not be responsible for photographs/videos that are not produced due to technical failure.

5.4 Upon the unlikely event of a mass loss of data or file corruption the creator can only accept liability to return all payment made as a result of the booking.

6. Creative Licence
6.1 The entire copyright and intellectual property of all media materials created by or for the creator shall vest in and be retained by the creator at all times unless directly purchased from the creator.

6.2 Library Of Sounds shall be granted creative and artistic licence in relation to the choice of locations and poses used. Library Of Sounds judgement on photographic style and the number of photographs/videos taken shall be deemed correct.

6.3 Some photographs/videos may not be possible due to changes in the weather and the availability and willingness of subjects. Library Of Sounds will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

7. Obstructions & Limitations
7.1 The Client(s) must agree to give the creator full precedence over any event attendees in order to capture the images/content required for the service provided.

7.2 It is advised that the client(s) make themselves aware of any limitations that may be put in the creator's way and advise the creator prior to the day.

8. Storage of Media
8.1 The client's raw media will be held on the creator’s personal storage for 1 month after the date the client(s) have been invoiced, the client should take the necessary steps to store and duplicate any media to avoid any loss of materials.

8.2 The creator has the right to delete any files remaining after the 1 month grace period.

8.3 The creator will not be responsible for the client losing any material.
